Mental Health Law & Tribunal Representation
 

ASAP Law practices exclusively in mental health matters.  As a social justice firm with a focus on patient advocacy, we accept certificates under the Legal Aid Ontario Plan.

We represent clients navigating complex mental health challenges, including involuntary hospitalization, capacity assessments, and treatment decisions.  Our lawyers have extensive experience appearing before the Consent and Capacity Board and the Ontario Review Board, where we advocate for your rights with care, clarity, and respect.  Whether you're facing a hearing about your capacity, detention, or ongoing supervision, we ensure you are heard, understood, and supported throughout the legal process.

Consent and Capacity Board Representation

 

The Consent and Capacity Board is an independent Hearing panel in Ontario that makes important Decisions about a person’s capacity, treatment, and detention in psychiatric facilities.  We represent clients in hearings involving:

  • Involuntary admission and renewal of detention in hospital

  • Capacity to consent to or refuse treatment

  • Capacity to manage property

  • Appointment or review of substitute decision-makers

  • Community Treatment Orders

 

Hearings can move quickly and feel overwhelming.  We provide timely, knowledgeable representation to protect your rights, advocate for your preferences, and ensure you fully understand the process and outcomes.

Ontario Review Board Representation

The Ontario Review Board oversees individuals found Not Criminally Responsible (NCR) or Unfit to Stand Trial due to a mental disorder.  We represent clients at annual ORB hearings and in applications for absolute discharge, conditional discharge, or changes to Disposition conditions.

Our team understands the long-term impact of ORB decisions on liberty, dignity, and quality of life.

We work with our clients to develop a clear plan, gather supporting evidence, and present our client's perspective in a way that reflects their progress, needs, and goals.
